DOCTOR SERVICE AGREEMENT

‘CityDoctor Physician’, ‘CityDoctor’ & but not limited to ‘https://citydoctor.in’ Platform.

Introduction : 

“CityDoctor Digital Health Care” (referred to as "we," "us," "our," or ‘CityDoctor’) a legally registered partnership firm in India. ‘CityDoctor’ & ‘CityDoctor Physician’ application is owned and operated by “CityDoctor Digital Health Care”.  

The application is published, managed & maintain by the partnership's authorized representative.

Please read this Doctor Service Agreement carefully before accessing or using the Website (https:citydoctor.in), mobile applications (‘Citydoctor’ & ‘CityDoctor Physician’), or any of the Services offered by ‘CityDoctor’. By accessing or using our Website, applications, or Services, you acknowledge that you have read, understood, and agreed to the terms of this Agreement, which forms an integral part of the Terms & Conditions for Doctors, Privacy Policy for Doctors governing your use of the Services. Together, the Terms & Conditions, Privacy policy and this Agreement constitute a legally binding agreement ("Agreement") between you and “CityDoctor Digital Health Care” regarding your access to and use of the Website, mobile applications, and Services.

“CityDoctor Digital Health Care” provides these Services directly and, where applicable, through its authorized representatives, affiliates, associates, technology partners, and other third-party service providers (collectively referred to as "Partners").

This Doctor Service Agreement ("Agreement") is entered into between CityDoctor Digital Health Care ("CityDoctor") and the registered medical practitioner ("Doctor") using the “CityDoctor Physician App” and related services.

1. Purpose
CityDoctor provides a digital platform enabling doctors to:
Create professional profiles
Display chamber and practice information
Receive appointment requests
Manage patient interactions through platform features
Access premium promotional services (if subscribed)
This Agreement governs the relationship between CityDoctor and the Doctor.

2. Eligibility
The Doctor confirms that:
He/She is legally authorized to practice medicine.
All qualifications and registrations are genuine.
All information submitted is accurate and up to date.
The Doctor shall immediately notify CityDoctor of any change affecting eligibility.

3. Doctor Profile Listing
The Doctor authorizes CityDoctor to publish:
Name
Qualification
Registration Number
Specialty
Chamber Address
Consultation Timings
Contact Information
Professional Photograph
Other professional details submitted by the Doctor
for the purpose of healthcare discovery and patient information.

4. Premium Services
CityDoctor may offer paid services including:
Featured Doctor Listings
Sponsored Placement
Advertisement Packages
Priority Search Visibility
Appointment Management Tools
Smart Queue Services
Additional Digital Services
Use of premium services shall be governed by the applicable pricing plan.

5. Payments
Where applicable:
Fees shall be paid in advance.
Payment obligations remain valid regardless of appointment volume.
Taxes, if applicable, shall be borne by the Doctor.
CityDoctor may revise pricing upon prior notice.

6. Refund Policy
Unless otherwise stated:
Subscription fees are non-refundable.
Advertisement fees are non-refundable after activation.
Promotional services already delivered shall not qualify for refunds.
Refunds may be granted solely at CityDoctor's discretion.

7. Doctor Responsibilities
The Doctor agrees to:
Maintain accurate profile information.
Honor scheduled appointments whenever possible.
Follow professional ethics and applicable laws.
Protect patient confidentiality.
Refrain from misleading advertising.
Refrain from making false claims regarding qualifications or treatment outcomes.

8. Patient Data Protection
Any patient information accessed through the platform shall:
Remain confidential.
Be used solely for healthcare-related purposes.
Not be sold, transferred, or disclosed without lawful authority.
The Doctor remains solely responsible for compliance with applicable privacy obligations.

9. Smart Queue & Presence Status
Where enabled, Doctors may update their availability status.
Examples:
Available
In Chamber
Busy
Away
Closed
The Doctor acknowledges that such status may be displayed publicly to users.

10. Prohibited Conduct
The Doctor shall not:
Provide false registration details.
Impersonate another practitioner.
Misuse patient data.
Engage in fraudulent activity.
Attempt unauthorized access to platform systems.
Use the platform for unlawful purposes.

11. Intellectual Property
CityDoctor retains ownership of:
Software
Logos
Branding
Design Elements
Platform Content
Nothing in this Agreement transfers ownership rights to the Doctor.

12. Disclaimer
‘CityDoctor’ is a technology service provider only.
‘CityDoctor’:
Does not provide medical services.
Does not guarantee patient acquisition.
Does not guarantee appointment volume.
Does not participate in clinical decisions.
All professional medical services remain the sole responsibility of the Doctor.

13. Limitation of Liability
‘CityDoctor’ shall not be liable for:
Loss of earnings
Patient disputes
Medical negligence claims
Professional misconduct allegations
Service interruptions
Technical failures
Indirect or consequential losses

14. Indemnification
The Doctor agrees to indemnify and hold harmless CityDoctor from claims arising out of:
Professional medical services rendered by the Doctor.
Violation of applicable laws.
Violation of this Agreement.
Misrepresentation of qualifications or credentials.

15. Suspension and Termination
CityDoctor may suspend or terminate services if:
False information is discovered.
Verification fails.
Professional registration expires or becomes invalid.
The Doctor violates platform policies.
Fraudulent or unethical conduct is detected.

16. Modification of Services
CityDoctor reserves the right to:
Modify platform features.
Introduce new services.
Change pricing structures.
Discontinue services where necessary.

17. Governing Law
This Agreement shall be governed by the laws of India.
Any disputes shall be subject to the jurisdiction of the courts having jurisdiction over the registered office of CityDoctor.
